Website Terms of Use
1. About this website and these terms
Welcome to RefineX, a website providing information about precious-metal refining enquiries and a way to contact our team. These Website Terms of Use apply when you browse https://refinex.org/ or use its enquiry facilities.
The website is operated under the RefineX trading name by The Gold and Diamond Dealer (Pty) Ltd, registration number 2026/263142/07. Questions about the website may be sent to info@refinex.org.
These terms govern the website. They are not the full terms of an assay, material purchase, refining, collection, recovery or settlement transaction.
2. Information about our services
The website introduces refining-related services for gold, silver, platinum-group metals and copper-bearing materials, and describes the information we need to start a conversation about a customer’s material. The suitability of a particular material, available treatment, service location and commercial terms can only be confirmed after the relevant details have been considered.
Descriptions and examples are not an instruction to deliver material or a standing offer to accept every item in a listed category. Please contact RefineX before sending materials, visiting premises, arranging a collection or relying on a proposed service.
3. Enquiries, quotations and agreements
Completing the contact form or exchanging preliminary information allows us to respond and consider a potential next step. It does not, by itself, obligate either party to proceed with a transaction.
If the parties agree to proceed, the authorised parties must confirm the scope and any relevant sampling, processing, commercial, custody, transport, payment or settlement conditions in a separate written quotation, work order or agreement. The Refining Services & Customer Acceptance Terms explain the matters that should be addressed before a transaction is accepted. The separately agreed contract and mandatory law govern that transaction.
4. Your responsibilities when using the website
You agree to use the site lawfully and responsibly. In particular, you must not misrepresent your identity, ownership or authority, submit information you know to be false, interfere with the site’s operation, attempt unauthorised access, introduce malicious software or use information from the site to facilitate unlawful conduct.
When contacting us on behalf of a business or another person, you are responsible for having appropriate authority to do so. Please do not submit confidential third-party information unless you are authorised and it is reasonably needed for your enquiry.
5. Accuracy and availability
We take care to present information clearly, but general website content may not reflect every material, regulatory or commercial consideration affecting a specific enquiry. We may correct content, revise descriptions or carry out maintenance. If information is important to your proposed transaction, please confirm it directly with our team before acting on it.
We do not promise uninterrupted access to the website. Nothing in these terms limits a right or remedy that cannot lawfully be limited under South African law.
6. Illustrations and intellectual property
The RefineX name, branding, original content and other protected material may not be reproduced or used unlawfully. Photographs and videos may be illustrative of industrial materials or processes; they are not proof that a specific machine, facility or depicted operation is owned or operated by RefineX. Technical capability and actual services must be confirmed separately.
You may refer to information on the website for personal or legitimate business evaluation, subject to applicable intellectual-property rights and fair use permitted by law.
7. Links to other services
The website may link to external services, such as messaging platforms, government information resources or other websites. We do not control those providers’ services, websites, terms or privacy practices. Following an external link is your decision and may be subject to the provider’s own conditions.
8. Privacy and communications
When you send an enquiry, we process the details you provide for the purposes described in the Privacy Policy. Any follow-up about the enquiry is different from an agreement to receive promotional marketing. Please consult the Privacy Policy for information about data-subject rights, disclosures and contact procedures.
9. Applicable law and questions
The website is intended to operate within the laws of the Republic of South Africa, subject to applicable mandatory rights and jurisdiction rules. Any specific transaction may have additional agreed terms. Contact info@refinex.org if you need clarification before relying on information on the website.
10. Updates
We may revise these Website Terms of Use. The published version and its effective date will be displayed on this page. A website update does not automatically change a separately agreed transaction contract.
